Berhampur: Even as Berhampur police is doing its best to enforce traffic rules, the cases related to assault by public on Cop when discharging his/her duties in a very disciplinary manner.

Recent past the Berhampur police have caught over thousands  people for not wearing face masks or violating social distancing ,moving in wrong traffic road, without helmet etc..Ofcources there may be some minor faults may be from Police side but not as Mandatory mistakes with all staff members.It may be very rare instances.

The Superintendent of Police, Berhampur Pinak Mishra said, now a day’s our hands are tight and we are bit liberal while during the period of Covid-19 pandemic under shutdown people of the city arguing with on duty staff asking for violation of guidelines and some of them are imposing as very powerful man, having lobby at top level as well most influenced persons.(?).

Notably.during the period, the Berhampur police have registered cases, arrested anti socials, persons and penalised on charge of COVID guideline violation.

In view of the corona virus surge in the ongoing second spell, the Odisha government has doubled the amount of penalty for not wearing face masks in public places to Rs 2000. This amount is charged for two times and from third chance onward the penalty is Rs 5000 for every violation. Non-compliance of COVID protocol is resulting in spike in COVID cases with every passing day.

This apart, police have collected fines for various other violations, the Officer said. They have also registered cases under Excise Act and seized quantum ltrs of liquor. Campaign has been intensified to make people follow COVID curbs, which includes enforcing use of masks, Use of Helmet, social distancing, implementation of night curfew, weekend ,he said.

There are a number of statutes in Berhampur City  that prohibit disobedience of or resistance to a duty enforcement police officer.Disobeying a lawful order of a police officer carries higher penalties to those who refuse to follow orders lawfully issued.

In operation of a motor vehicle or bike or who is a pedestrian on a public road;

Provided a lawful direction or order from a police officer; and Intentionally refuses or fails to comply with that lawful order or direction.

It’s important to stipulate that the term “police officer” as used in the statute can mean a number of different things. It applies not just to actual Berhampur police officers, but also Odisha Police traffic crash investigators or traffic enforcement officers or may be Officer of any Police stations.

People are wrongly under the impression that this means something dramatic, like running away from an officer or violently resisting. These actions are crimes within their own right. However, disobeying a police officer as it is understood in this statute could mean as;

Refusing to stop when the officer signaled to you do so (?)

Refusing to give the officer your license and registration when asked to present.

In addition to exploring the typical defenses we would for any criminal case (i.e., lack of evidence, warrantless stop, motion to suppress, etc.), we would also look at.

The policemen had questioned by the Public other side identified as Violator.

So,the public must understand the gravity and the responsibility is Ours than Police for Obeying the guideline.
