CONFIRMED BY OPID COURT, CUTTACK IN PLOT/LAND FRAUD CASE
Bhubanesswar:In the year 2017, EOW PS Case No.11 dt.29.05.2017 u/s 467/468/471/
420/406/120-B IPC r/w Sec.6 of OPID Act, 2011 was registered on the allegation
of Bidhu Bhusan Mohanty against M/s Surya Nirman Resources (P) Ltd. and its MD, Chinmay Mallick and Directors Rojalin Mallick and Biswajit Pattnaik, who allegedly collected public deposits of more than Rs.2 Crores under the promise of providing litigation free plots/land at Chandaka or otherwise to pay back the invested amount with high returns through its different money back policy/schemes.
Subsequently, the company neither provided the land/plots nor did it return the promised amount with returns to the Investors/Depositors, and misappropriated the same.
During the year 2010-15, the Directors of the Company M/s Surya Nirman Resources (P) Ltd. by floating different plans/schemes collected the public deposits from more than 100 persons to the tune of more than Rs.2 Crores, without any authority for providing litigation free plots/land at Chandaka.
The amount was collected by inducing the general public through distribution of
colourful brochures containing different lucrative/attractive schemes, leaflets etc.
apart from personal motivation/inducement by the agents of the company.
The company had promised to provide litigation free plots/land at Chandaka to the investors and also to pay high returns on the invested amount through its different schemes and money back policies like ‘Jeevan’ and ‘Jeevan (Gems)’.
After the unauthorized collection of more than Rs.2 Crores from the depositors/investors, the company failed to provide the plots/land to the investors and also to return the invested amount.
During investigation, the details of moveable/immoveable properties standing in the name of the company and its Directors were collected from IGR, Cuttack, and landed properties of Ac.17.468 Dec. at Krushna Nagar, Chandaka, Kantabada under Khordha District and Kujanga & Padampur under Jagatsinghpur District were traced to be in the name of the company and its Directors.
Ad-interim proposal for attachment of the above landed properties worth Rs.2,07,85,349/- was submitted by EOW on 07.03.2018 under the provision of Sec.3 of OPID Act to the Govt. in Finance Dept. and accordingly the above landed properties were attached by the Govt. in Finance Dept. On 09.04.2018.
The Hon’ble Designated Court under OPID Act, Cuttack vide order dt.17.10.2023 in I.A. No.05/2018 made the ad-interim order of attachment absolute (confirmed) and directed competent authority i.e. ADM-cum- Competent Authority under OPID Act, Cuttack, to sale the immovable properties through Public Auction for equitable distribution of the proceeds among the investors/depositors.
