Bhubaneswar:In the year 2015, EOW, Bhubaneswar had registered EOW Case No.09

dt.15.03.2015 U/s 467/468/471/406/420/120-B IPC r.w. Sec. 6 of OPID Act against M/s

Sarala Realcon Pvt. Ltd. and its Managing Director Gayadhar Jena and other Directors

on the allegation of collecting crores of rupees from public unauthorized/illegally with

assurance to provide them with home stayed land/plot in different prime locations. But,the accused persons and the company M/s Sarala Realcon Pvt. Ltd. instead of honouring the commitment made by them to the depositors/investors defaulted in providing with the land and thus, failed to render such service and also failed to refund the deposited amount. It was ascertained during investigation that the accused company and its Managing Director and Directors fabricated false documents and thereby executed registered sale deeds so as to act in a calculated manner with an intention to cheat/defraud the depositors/intending buyers. The accused persons duped 238 investors/intending buyers to the tune of Rs.17 Cr. approx. in the name of providing land/plots. After completion of investigation, charge-sheet in this case has been filed U/s 467/468/471/420/120-B IPC r.w. Sec. 6 of OPID Act, 2011 against M/s Sarala Realcon Pvt. Ltd. and its Managing Director Gayadhar Jena and five others. The case is now subjudice in the designated court under OPID Act, Cuttack.

During investigation of the case, the movable and immovable properties created by the accused MD Gayadhar Jena and other Directors out of the public deposits in their names as well as in the name of the company M/s Sarala Realcon Pvt. Ltd. Were traced and an ad-interim proposal for attachment of those properties was submitted by EOW on 02.07.2016 under the provision of Sec.3 of OPID Act. On the basis of said proposal, the Govt. of Odisha, Finance Dept. had issued ad-interim Order for attachment of properties on 19.10.2016.

The Hon’ble Designated Court under OPID Act, Cuttack in their order dt.14.10.2022 has made the ad-interim order of attachment absolute and directed competent authority i.e. ADM, Cuttack to sale the immovable properties through Public auction and also to realize the amount deposited in bank accounts along with interets accrued thereon for equitable distribution among duped investors. The properties include immovable landed property of area more than 95 acres cost around Rs.13.81 Cr., frozen bank balance of Rs.13,10,316/-, seized cash of Rs.3,25,600/- and four vehicles i.e.Scorpio Hawk ABS, Pajero SFX, BMW-X5-3, OD SAV and Toyota Fortuner
