OAS OFFICER & OTHERS CONVICTED IN VIGILANCE CASE

Cuttack,29/06/2017:With respect to Koraput Vigilance case No 15 dt.31.03.2008 U/s 13(2) r/w 13(1)(d) P.C.Act.1988/418/420/468/120-B IPC on dated 29.06.2017, the Hon’ble Special Judge, Vigilance, Bhawanipatna convicted (1) Benjamin Prasad Deogam, OAS-I, Ex-BDO, Khariar Block, Nuapada, presently working as  Deputy Secretary, Tourism Deptt., Odisha, (2) Labanya Sundar Nayak, Ex-Head Clerk, Khariar Block (3) Tarachand Agrawal, Proprietor M/s Raj Kumar Agrawala (private person) and sentenced them to undergo R.I for a period of two  years and to pay fine of Rs.1,000/- each on each count, in default, to undergo R.I for 01 month  on each count   for the offence U/s 420/468/120-B IPC.  Further, sentenced them to undergo R.I for 01 year each for the offence U/s 418 IPC. Sri Deogam and Sri Nayak  are further sentenced to undergo R.I for a period of 02 years and to pay fine of Rs.2,000/- each on each count, in default, to undergo R.I for a period of 01 month each on each count for the offence U/s 13(2) r/w 13(1)(d) P.C.Act, 1988.  Substantive sentences are to run concurrently. 

 

 

The above noted case was registered against the above noted accused persons for manipulation of records and showing undue official favour to Sri Agrawal, supplier by entertaining forged quotations and issuing purchase orders to him to supply 06 nos. of Sriram Freezer Aqua cooler of higher capacity causing excess payment to the tune of Rs.2,94,600/- and causing additional loss of Rs.61,560/- towards tax. On completion of investigation, the case was charge sheeted against them to face the trial in the court of  law.

 

Sri Asutosh Mishra, Spl. P.P, Vigilance, Bhawanipatna conducted the case on behalf of the prosecution. Sri Sisir Kumar Bhoi, Ex-DSP, Vigilance, Rayagada Unit investigated into the case.

 

Similarly in another success by Balasore Vigilance vide the case no: 13 dt.27.02.2005 U/s 13(2) r/w 13(1)(d) / 7 P.C.Act.1988. one Revenue Inspector convicted in Vigilance case on 29.06.2017.

 

The Hon’ble Special Judge, Vigilance, Balasore convicted the accused Narayan Chandra Behera, Ex-Revenue Inspector, Nagram, Balasore (retd.) andsentenced him to undergo R.I for a period of 06 months and to pay fine of Rs.5,000/-, in default, to undergo R.I for 01 month for the offence U/s 7 P.C.Act.  Further, sentenced him to undergo R.I for 01 year and to pay fine of Rs.5,000/-, in default, to undergo R.I for a period of 02 months for the offence U/s 13(1)(d) P.C.Act, 1988.  Substantive sentences are to run concurrently.

 

 

The above noted case was registered against Sri Behera for demanding and accepting illegal gratification of Rs.300/- from the complt. Ramakanta Nayak to issue enquiry report in mutation case No.1501/05. On completion of investigation, the case was charge sheeted against him to face the trial in the court of  law.  Sk. Haziruddin, Spl. P.P, Vigilance, Balasore conducted the case on behalf of the prosecution.  Santanu Kumar Mohanty, Ex-Inspector, Vigilance, Balasore Division investigated into the case.
