Jogesh Singh’s election to Assembly;SC stays Orissa HC order

Bhubaneswar,13/02/18: In a major relief for Congress leader Jogesh Singh, the Supreme Court on Tuesday issued an interim stay order on the Orissa High Court’s judgement annulling the election of Singh to the Assembly from Sundargarh constituency.

 

A two-member bench of judges comprising Justice A.K. Sikri and Justice Ashok Bhushan ruled out the decision of the HC today, informed Singh’s counsel Pitambar Acharya.

 

Earlier on January 30, the HC Justice B K Nayak, had annulled Singh's election after finding discrepancies in his affidavits submitted during the time of filing his nomination papers.

 

“I thank the people Sundergarh and the apex court for the decision. I was having full faith on the judiciary. I am very happy with judgement,” said Singh.

 

The HC order came after it adjudicated two election disputes filed by BJP candidate Sahadev Xaxa, who lost to Singh in the 2014 elections and a voter Ajay Patel. Both had alleged that Singh, despite not being a scheduled tribe (ST), had managed to obtain an ST certificate and contested the election from Sundargarh which is reserved for ST candidates.

 

Singh who had secured 66,138 votes defeated his nearest candidate Kusum Tete of ruling Biju Janata Dal (BJD) with a margin of 12,584 votes. There were nine candidates in the fray for the Sundargarh constituency in the 2014 elections.
